These Terms and Conditions ("Terms") govern your use of the services provided by Mobile Development Solutions ("we," "our," or "us"). By engaging our services, you agree to be bound by these Terms.

  • "Client" refers to the person or entity engaging our services
  • "Services" refers to all mobile app development, design, and related services we provide
  • "Work" refers to the specific mobile application or service to be developed

2. Services

We provide professional mobile app development, design, and related services. All services are subject to:

  • Project consultation and requirements analysis
  • Written quotation and acceptance
  • Availability of resources and scheduling
  • Compliance with applicable app store guidelines and regulations

3. Quotations and Pricing

3.1 Quotations

All quotations are valid for 30 days from the date of issue unless otherwise stated. Quotations are estimates based on the information provided and may be subject to change if site conditions differ from those described.

3.2 Pricing

Prices are quoted in British Pounds (GBP) and include VAT where applicable. All prices are subject to change without notice until a written quotation is accepted by the client.

3.3 Additional Costs

Additional costs may apply for:

  • Unforeseen technical requirements or complications
  • Changes to the original specification or scope
  • Additional features requested after commencement
  • Third-party API integrations or services

4. Payment Terms

4.1 Payment Schedule

Payment terms will be agreed upon before work commences. Typically:

  • A deposit may be required upon acceptance of quotation
  • Progress payments may be required for larger projects
  • Final payment is due upon completion and app store submission

4.2 Late Payment

If payment is not received by the due date, we reserve the right to:

  • Charge interest on overdue amounts at 8% per annum above the Bank of England base rate
  • Suspend work until payment is received
  • Pursue legal action to recover outstanding amounts

5. Work Performance

5.1 Standards

We will perform all work to professional standards using modern technologies and best practices. Work will comply with relevant app store guidelines and industry standards.

5.2 Access and Preparation

The client is responsible for:

  • Providing clear project requirements and specifications
  • Providing necessary content, images, and branding materials
  • Ensuring access to required APIs or third-party services
  • Obtaining necessary licenses or permissions for content

5.3 Completion

Work will be considered complete when:

  • All specified features have been developed and tested
  • The app has been submitted to app stores (if applicable)
  • The client has tested and accepted the work

6. Warranties and Guarantees

6.1 Workmanship Warranty

We provide a 6-month warranty on development work from the date of completion. This warranty covers bugs and defects in code but does not cover:

  • Issues caused by third-party services or APIs
  • Changes to operating systems or platform requirements
  • Issues with content or data provided by the client
  • Problems arising from unauthorized modifications

6.2 Material Warranties

Third-party services and libraries are subject to their own terms and warranties. We will assist with integration issues but are not responsible for third-party service failures.

7. Cancellation and Changes

7.1 Cancellation by Client

If the client cancels after acceptance of quotation:

  • Cancellation more than 7 days before start date: deposit may be refunded less administrative costs
  • Cancellation less than 7 days before start date: deposit is non-refundable
  • Cancellation after work commences: client is liable for all work completed and resources allocated

7.2 Changes to Work

Any changes to the original specification must be agreed upon in writing. Additional costs and time extensions may apply.

8. Liability

8.1 Limitation of Liability

Our liability is limited to the value of the work performed. We are not liable for:

  • Consequential or indirect losses
  • Loss of profit or business interruption
  • Damage to property not directly caused by our negligence

8.2 Insurance

We maintain public liability insurance. Details are available upon request.

9. Disputes

Any disputes will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or government actions.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the accepted quotation, constitute the entire agreement between the parties.

11.2 Modifications

These Terms may be modified at any time. Continued use of our services constitutes acceptance of modified Terms.

11.3 Severability

If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force and effect.
